Banking and financial law

The Monegasque financial law is mainly governed by the following texts :
  • Law No. 1.338 of September 7, 2007 on  financial activities;
  • Law No.1.339 of September 7, 2007  on mutual funds and investment funds;
  • Implementing ordinance No.1.284 of September 10, 2007, on financial activities;
  • Implementing ordinance No.1.285 of September 10, 2007, on mutual funds and investment funds.

The banks regulatory and prudential organisation is ruled by the French monetary and financial code whereas the relations between the bank and its clients are governed by the Monegasque law.

Because  two systems of laws can be applied, the process of creation, acquisition or transfer of banks in Monaco is subject to imperative constraints imposed by the French and Monegasque supervisory authorities.

In consideration of the limited number of texts, case law has a key role in Monegasque banking and financial law.

We work with banks, portfolio management companies and insurance companies in financing, drafting of guarantees and litigation.

We also bring our knowledge and experience in capital restructuring, creation, purchase or sale of banks in Monaco.

After spending several years in an international law firm in Paris, Patricia KEMAYOU MENGUE joined ABN Monaco Bank as an in-house counsel prior to joining our firm in 2001. Due to her legal and operational knowledge of the banking sector, Patricia KEMAYOU MENGUE is the preferred contact for professionals. Her integral knowledge of litigation enables her to  skilfully advise clients when negotiating and drafting international contracts. She heads the Business Law Department.

She holds a First Degree Masters in Business and Tax Law from the University of Bourgogne and a Second Degree Masters in Business Law from the University of Dijon. She was admitted to the Paris Bar in 1995.

She is fluent in French and in English and also enjoys speaking Spanish.
